CUESTIÓN DE LA VIOLACIÓN DE LOS DERECHOS HUMANOS EN LOS TERRITORIOS ÁRABES OCUPADOS, INCLUIDA PALESTINA
Carta de fecha 13 de agosto de 2001 dirigida a la Alta Comisionada
de las Naciones Unidas para los Derechos Humanos por el
Observador Permanente de Palestina ante la Oficina de
las Naciones Unidas en Ginebra
Israel, la Potencia ocupante, mantiene la escalada en su guerra criminal contra el pueblo palestino y sigue cometiendo violaciones manifiestas de los principios de la Declaración Universal de Derechos Humanos, las disposiciones de ambos Pactos internacionales de derechos humanos, los principios y disposiciones del Cuarto Convenio de Ginebra relativo a la protección debida a las personas civiles en tiempo de guerra y del derecho internacional humanitario, así como de la Convención de las Naciones Unidas para la Prevención y la Sanción del Delito de Genocidio.
Tengo el pesar de informarle que Israel, la Potencia ocupante, ha cometido otros crímenes feroces contra el pueblo palestino en los territorios palestinos ocupados, incluso en Jerusalén.
El lunes 23 de julio Mustafá Yaseen, de 26 años, oriundo de Anín, distrito de Yenín, fue asesinado delante de su esposa e hijo. Unos 40 soldados y miembros de las Fuerzas Especiales israelíes vestidos de civil rodearon su casa, lo llamaron para que saliera y le dispararon al pecho y la espalda.
El martes 24 de julio las fuerzas israelíes asesinaron a Salah Darwaza, de 38 años, oriundo de Naplusa, lanzando misiles contra su coche desde un helicóptero en momentos en que circulaba por la calle Haifa, de Naplusa, alcanzando directamente al coche. Darwaza murió en el acto.
El domingo 29 de julio de 2001 un gran número de soldados, policías y guardias fronterizos israelíes irrumpieron en el Sagrado Santuario ubicado en el corazón de Jerusalén, dispararon balas reales, de metal, y lanzaron gases lacrimógenos contra fieles desarmados, entre los que había ancianos y niños, los agredieron con porras, los golpearon severamente e hirieron a 40 de ellos.
Estos incidentes se produjeron en momentos en que las fuerzas israelíes protegían a extremistas judíos que estaban tratando de colocar una piedra angular de 4,5 toneladas que simbolizaba la construcción de un templo judío para reemplazar el santuario musulmán. Esta acción ilegal, que fue autorizada por el Tribunal Superior israelí, tiene por finalidad modificar el estatuto jurídico y el carácter religioso y cultural de la Jerusalén ocupada, en flagrante violación de las resoluciones pertinentes de las Naciones Unidas y del Cuarto Convenio de Ginebra relativo a la protección debida a las personas civiles en tiempo de guerra, de 1949.
Ese mismo día el Gobierno de Israel asesinó a seis civiles palestinos en la ciudad de Yenín, como parte de su política de asesinatos selectivos.
El martes 31 de julio de 2001, en una peligrosa escalada de la guerra criminal de Israel contra el pueblo palestino y en flagrante violación del derecho a la vida, unos helicópteros de ataque israelíes dispararon dos cohetes contra un edificio de apartamentos en el centro de Naplusa, matando a ocho palestinos. En el ataque murieron cuatro personas que no tenían vinculación alguna con ninguna acción política, entre ellas dos hermanos de 8 y 10 años de edad. Los misiles que dieron en el edificio fueron disparados por dos helicópteros Apache que habían sido vistos en el momento del ataque sobrevolando la zona sur de Naplusa. Otras 22 personas resultaron heridas, entre ellas 3 que se encuentran en estado crítico.
La matanza de civiles inocentes no resulta sorprendente. Los dirigentes civiles y militares que ordenan a sabiendas esos ataques están cometiendo actos de terrorismo de Estado, actos de terrorismo que se distinguen de otros tipos de terrorismo sólo por la enorme potencia de fuego de que dispone la Fuerza Aérea israelí.
A la luz de esa guerra criminal emprendida contra la población civil palestina, formulamos un llamamiento a la comunidad internacional para que ésta intervenga ante el Gobierno de Israel y le pida que ponga fin a sus crímenes contra civiles palestinos desarmados y a su política de sanciones colectivas, que estrangulan a toda una población, niños, mujeres y ancianos, y para que considere que los funcionarios y oficiales israelíes son responsables de los crímenes de guerra que cometen contra el pueblo palestino, de conformidad con el derecho internacional humanitario.
También reiteramos nuestro llamamiento a la comunidad internacional para que ésta pida que se establezca inmediatamente una fuerza internacional de observación a fin de proteger a los civiles palestinos, y garantice el cumplimiento por Israel de las resoluciones pertinentes de las Naciones Unidas, así como el respeto del derecho internacional, del derecho internacional humanitario y de los acuerdos existentes entre Palestina e Israel.
Lamentablemente cada día sigue aumentando el número de palestinos muertos por el uso excesivo e indiscriminado de la fuerza por las fuerzas de ocupación israelíes y su política ilegal y criminal de ejecuciones extrajudiciales. Además, un número mucho mayor de civiles palestinos han resultado heridos, gran parte de ellos de gravedad y con lesiones de carácter permanente.
Adjunto a la presente la lista de los mártires palestinos que murieron del 21 al 31 de julio, y que debe añadirse a las anteriores sobre el mismo tema.
